Women’s Holistic Ultrasound Care Terms, Conditions & Informed Consent

Please Read Carefully Before Booking or Receiving Services

1. Nature of Services

All services provided by Women’s Holistic Ultrasound Care are elective, self-pay, limited-scope services. Services may include diagnostic ultrasound imaging, blood collection services such as NIPT or related prenatal screening, and other wellness or women’s imaging services offered by the practice.

You understand and agree that Women’s Holistic Ultrasound Care does not provide emergency care and is not a substitute for a hospital, urgent care center, obstetrician, primary care physician, specialist, or any other licensed treating medical provider.

2. No Emergency Services

This facility does not evaluate or manage emergency medical conditions. If you are experiencing pain, heavy bleeding, reduced fetal movement, dizziness, fainting, chest pain, shortness of breath, severe swelling, signs of miscarriage, signs of ectopic pregnancy, signs of labor, or any other urgent or emergent medical concern, you must immediately contact your physician or seek care at the nearest emergency room or urgent medical facility.

3. Diagnostic Ultrasound Services

When diagnostic ultrasound services are provided, the scan is performed by a trained sonographer. The ultrasound images are submitted to an independent licensed radiologist for interpretation, when applicable. A formal report, when included, is based only on the images captured during your appointment.

• The sonographer is not acting as your treating physician.
• The sonographer does not diagnose, prescribe treatment, or provide clinical follow-up.
• The medical director and supervising personnel are not assuming ongoing responsibility for your medical care.
• You are solely responsible for following up with your own healthcare provider regarding your symptoms, results, report, recommendations, and any necessary additional testing or treatment.

4. Independent Radiology Interpretation

Radiology interpretation, if provided, is performed by an independent licensed radiologist or radiology group. The radiologist is not an employee of Women’s Holistic Ultrasound Care unless expressly stated otherwise in writing. Women’s Holistic Ultrasound Care is facilitating the imaging service and transmission of images, but is not guaranteeing the speed, completeness, wording, or medical conclusions of the radiology report.

You understand that any report is limited by image quality, patient anatomy, movement, body habitus, gas, fetal position, gestational age, organ visibility, technical limitations, and other factors outside the facility’s control.

5. Limitations of Ultrasound Imaging

Ultrasound has inherent limitations. Not all anatomy, pathology, abnormalities, organs, structures, fetal features, or findings can be seen on every patient or during every exam. Image quality and diagnostic value may be reduced by factors including, but not limited to, fetal position, gestational age, maternal anatomy, bowel gas, scar tissue, fluid status, movement, technical interference, and time limitations.

No guarantee is made regarding:

• Image clarity or image quality
• Complete visualization of all anatomy or organs
• Detection or exclusion of any condition, abnormality, anomaly, disease, pregnancy complication, or pathology
• Specific outcomes, reassurance, or expected findings

6. Non-Substitution for Medical Care

You agree that no service provided at this facility replaces routine prenatal care, OB/GYN care, specialist care, primary care, laboratory testing, hospital evaluation, or any medically necessary follow-up. You agree not to delay, avoid, or refuse proper medical care based on any information, images, impressions, statements, or reports connected to your visit.

7. Blood Draw, NIPT, and Third-Party Laboratory Services

If your appointment includes NIPT, prenatal screening, blood collection, or any laboratory-based service, you understand that Women’s Holistic Ultrasound Care may collect and submit your specimen, but the testing itself is performed by an independent third-party laboratory.

• Women’s Holistic Ultrasound Care is not the testing laboratory.
• Women’s Holistic Ultrasound Care does not control laboratory processing times, shipping times, coverage decisions, claims handling, lost samples, sample rejection, inconclusive results, damaged specimens, redraw requirements, corrected reports, or laboratory errors.
• Lab-based testing is not guaranteed to be covered by insurance.
• Any quoted estimate, self-pay amount, billed-later amount, sliding scale possibility, or financial assistance possibility is subject to the policies of the third-party laboratory and may change without notice.
• Screening tests such as NIPT are screening tools and are not diagnostic. False positives, false negatives, inconclusive results, no-calls, redraws, and laboratory discrepancies can occur.

8. No Guarantee of Gender, Findings, or Medical Outcome

No specific result is guaranteed. This includes, without limitation, gender determination, normal findings, abnormal findings, complete results, peace of mind, image quality, fetal cooperation, lab turnaround time, report timing, insurance coverage, or any emotional or medical outcome you hoped for when booking.

9. Payment Terms

All fees are due according to the payment terms presented at the time of booking or service. Unless expressly stated otherwise in writing, services are self-pay. Payment is for reserved appointment time, use of equipment, staff time, specimen collection when applicable, administrative handling, and imaging services rendered. Payment is not contingent upon image quality, radiology findings, laboratory findings, emotional satisfaction, or the medical usefulness of the result to you.

10. No Refund Policy

All sales are final once any portion of the service has begun. No refunds will be issued for, including but not limited to:

• Unclear, limited, or incomplete images
• Biological, anatomical, fetal, or technical limitations
• Inconclusive or unexpected findings
• Dissatisfaction with images, report wording, or laboratory result timing
• Need for additional medical follow-up
• Laboratory processing delays, redraws, rejected samples, or inconclusive lab results
• Failure to follow preparation instructions
• Late arrival, missed appointment, shortened appointment, or scheduling issues
• Power outage, technical malfunction, network issue, or events outside the facility’s control

11. Rescans or Repeat Services

If a repeat scan, courtesy rescan, redraw, or repeat service is ever offered, it is offered solely at the discretion of Women’s Holistic Ultrasound Care, is not guaranteed, and does not waive any other term in this agreement. The facility may limit the days, timing, scope, availability, and conditions of any discretionary repeat service.

12. Patient Responsibility for Accurate Information

You agree to provide complete, truthful, and accurate information about your medical history, symptoms, pregnancy dating, prior imaging, medications, physician information, and any other information requested. Women’s Holistic Ultrasound Care is not responsible for any problem, delay, error, or misunderstanding arising from false, incomplete, inaccurate, or omitted information provided by you or on your behalf.

13. Follow-Up Responsibility

You understand that it is your responsibility to obtain appropriate medical follow-up after your appointment. If a report or result recommends further evaluation, physician review, repeat imaging, or emergency care, you agree that it is solely your responsibility to act on that information promptly.

14. No Physician-Patient Relationship

Unless you are expressly entering into a separately documented treatment relationship with a physician, nothing about your appointment, scan, specimen collection, report facilitation, or communication from staff creates a continuing physician-patient relationship, provider-patient relationship, or duty of ongoing treatment, diagnosis, follow-up, or emergency response by Women’s Holistic Ultrasound Care, its sonographers, staff, contractors, medical director, or affiliated personnel.

15. Media, Digital Files, and Technical Issues

Any printed images, emailed files, texted images, videos, download links, USB media, courtesy digital items, or other media are provided as a convenience only. Women’s Holistic Ultrasound Care is not responsible for corrupted files, failed downloads, device incompatibility, email delivery problems, spam filtering, broken links, storage failure, or later inability to access files. You are responsible for saving and backing up any media promptly.

16. Privacy and Communications

You consent to reasonable communications related to your appointment, including phone calls, text messages, emails, radiology coordination, laboratory coordination, scheduling updates, billing communications, and follow-up administrative contact. You acknowledge that electronic communication carries inherent risks, including transmission delays and unintended access despite reasonable safeguards.

17. Release of Liability

To the fullest extent permitted by Florida law, you release and hold harmless Women’s Holistic Ultrasound Care, its owners, members, managers, DBAs, affiliates, subsidiaries, parents, employees, sonographers, contractors, medical director, supervising physicians, radiologists, laboratories, couriers, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to:

• Your use of the services
• Any limitation of ultrasound imaging
• Any report, interpretation, omission, wording, or radiology conclusion
• Any laboratory processing issue, delay, discrepancy, or result
• Your failure to seek or obtain appropriate medical follow-up
• Your dissatisfaction with images, reports, results, or service experience
• Any non-emergency medical issue, pregnancy complication, missed diagnosis, delayed diagnosis, or disease progression
• Any emotional distress, anxiety, disappointment, or expectation-based claim

18. Limitation of Liability

To the fullest extent permitted by law, the total liability of Women’s Holistic Ultrasound Care and all released parties for any claim of any kind arising from or related to your appointment or services shall be strictly limited to the amount actually paid by you to Women’s Holistic Ultrasound Care for the specific service giving rise to the claim. Under no circumstances shall any released party be liable for any incidental, consequential, indirect, special, exemplary, emotional, or punitive damages.

19. Indemnification

You agree to indemnify, defend, and hold harmless Women’s Holistic Ultrasound Care and all released parties from any claim, action, demand, loss, liability, or expense, including attorney’s fees, arising from your misuse of the service, your breach of these terms, inaccurate information you provide, your failure to follow medical advice, or any claim brought by a third party arising out of your appointment or presence at the facility.

20. Arbitration and Venue

Any dispute arising out of or relating in any way to the services, appointment, booking, payment, images, reports, laboratory services, communications, or these Terms and Conditions shall be resolved exclusively by binding arbitration in the State of Florida. You waive the right to a jury trial and waive the right to participate in any class action, consolidated action, or representative proceeding. To the extent court involvement is required, venue shall lie only in Orange County or Osceola County, Florida, and Florida law shall govern.

21. Severability and Enforceability

If any portion of these Terms and Conditions is found invalid or unenforceable, all remaining provisions shall remain in full force and effect. These Terms and Conditions shall be interpreted as broadly as permitted under applicable law to protect Women’s Holistic Ultrasound Care and the released parties.

22. Entire Agreement

These Terms and Conditions, together with any intake forms, acknowledgments, consent forms, financial policies, booking policies, and service-specific disclosures presented by Women’s Holistic Ultrasound Care, constitute the full agreement between you and the facility concerning your appointment and services.

23. Electronic Consent and Signature

By checking the acknowledgment box during booking, typing your name where requested, or proceeding with your appointment after having an opportunity to review these Terms and Conditions, you acknowledge that you have read, understood, and agreed to these Terms and Conditions and Informed Consent. You agree that your electronic acceptance is the legal equivalent of your handwritten signature and is intended to be binding under the ESIGN Act, Florida electronic signature law, and any other applicable law.
